Buying?  Protecting your investment should be your key goal

You want to know that all of the issues involved in buying your home are properly handled. Buying a property is not like buying an appliance or even a car.  It needs to be thoroughly researched, and all municipal records searched in order to ensure that there are no claims against the property, or encumbrances which could potentially interfere with your use and enjoyment of your home.

We work with your best interests uppermost, and can help you to plan your estate holdings, advise you on how to take title to the property, minimize land transfer taxes, and ensure that the property you think you have bought is the property you get.  As your home may well be the largest investment you will ever make, you owe it to yourself to ensure that you get proper legal advice.

That Offer to Purchase is the contract.  Once signed, it is binding and governs the whole deal.  So you need to think about all of the terms in that agreement.  Make sure that it specifically addresses your objectives and any concerns you may have.  A “standard form” agreement may not be appropriate in your case.  After all, how many “standard” things apply to you?  You have unique needs and desires, and the house you are buying or selling reflects your individual desires.  So why settle for a “standard” agreement?

As a buyer, are you concerned about the zoning of nearby properties? the quantity and quality of the well water? whether that outbuilding is legal or not? Did you get a warranty that the property conforms to building by-laws?  Have improvements been made without a building permit?  Did you make a complete list of chattels which you will acquire with the home?  Did you get an up-to-date building location survey from the Vendor, or will title insurance be sufficient for your concerns?  Do you have an escape clause if the property doesn’t measure up, or you can’t get financing?  Address the issues you feel are important in the Offer.  Remember,  you may be paying for your house for the next twenty five years.  So make sure the Offer will allow you to get what you pay for.

As a Seller, you have similar needs to ensure that the Agreement meets with all of your concerns.  Will you get paid?  Are there unusual obligations being placed on you?   What residual obligations will remain after closing?  We can help ensure that the Agreement meets all of your needs.
