Kingston Real Estate Lawyer

Buying? Selling? Re-financing?   We can help you to get your transaction complete

kingston real estate lawyerWe have a wide array of experience in completing real estate transactions.  Ian has worked on residential and commercial transactions of every conceivable size, and brings that experience to bear for you.  That means you get effective, experienced representation in your transaction.

Buying?  Protecting your investment should be your key goal

You want to know that all of the issues involved in buying your home are properly handled. Buying a property is not like buying an appliance or even a car.  It needs to be thoroughly researched, and all municipal records searched in order to ensure that there are no claims against the property, or encumbrances which could potentially interfere with your use and enjoyment of your home.

We work with your best interests uppermost, and can help you to plan your estate holdings, advise you on how to take title to the property, minimize land transfer taxes, and ensure that the property you think you have bought is the property you get.  As your home may well be the largest investment you will ever make, you owe it to yourself to ensure that you get proper legal advice.

Buying or Selling?  See a lawyer BEFORE you sign the offer

That Offer to Purchase is the contract.  Once signed, it is binding and governs the whole deal.  So you need to think about all of the terms in that agreement.  Make sure that it specifically addresses your objectives and any concerns you may have.  A “standard form” agreement may not be appropriate in your case.  After all, how many “standard” things apply to you?  You have unique needs and desires, and the house you are buying or selling reflects your individual desires.  So why settle for a “standard” agreement?

As a buyer, are you concerned about the zoning of nearby properties? the quantity and quality of the well water? whether that outbuilding is legal or not? Did you get a warranty that the property conforms to building by-laws?  Have improvements been made without a building permit?  Did you make a complete list of chattels which you will acquire with the home?  Did you get an up-to-date building location survey from the Vendor, or will title insurance be sufficient for your concerns?  Do you have an escape clause if the property doesn’t measure up, or you can’t get financing?  Address the issues you feel are important in the Offer.  Remember,  you may be paying for your house for the next twenty five years.  So make sure the Offer will allow you to get what you pay for.

As a Seller, you have similar needs to ensure that the Agreement meets with all of your concerns.  Will you get paid?  Are there unusual obligations being placed on you?   What residual obligations will remain after closing?  We can help ensure that the Agreement meets all of your needs.

Your Real Estate Lawyer is the final piece in the puzzle of finding and buying the home of your dreams

Green puzzle with missing piece shining with white lightYou will speak with a wide range of advisors when you buy a home.  Your real estate lawyer helps you find a home with the features you want, at a price you can afford.  Your Home inspector will look at the house and let you know what problems the structure may have.  Your mortgage advisor will seek to get you a mortgage loan you can afford.

Your lawyer should also be a key advisor.  He or she coordinates the other advisors in order to ensure that you get everything out of the property that you have paid for.  Your lawyer will check various details and advise you on a wide range of matters.  They can help you understand the typical institutional mortgage documentation.

Every business needs strong legal support – every day

Most Businesses can’t afford their own corporate lawyer, but still have to deal with a variety of corporate law and legal problems which can come along every day: advertising issues, intellectual property, employment contracts, supplier disputes, franchising issues, financing and even acquisitions or sale of the business.

He was part of one of Canada’s largest law firms – Borden Ladner Gervais, from 1986 until 1997, and served as sole legal counsel to Bell ExpressVu between 1997 and 2003, dealing with all kinds of business and corporate structural issues. His background includes serving as a corporate officer for a large number of companies.

Also, Ian is approachable and accessible to his corporate clients. So if a new problem develops, he is able and ready to assist you in finding a solution. It’s almost like having a lawyer in the next office. And we don’t charge you by the phone call or email. We only charge after you have approved the budget for the particular transaction!

Intellectual Property

Protecting your IP is key to business success

Your corporate identity is intertwined with your brand, and vice versa.  Branding is key to telling people who you are, what you sell, and how you do business. Your branding is the key to your reputation as a business, and is built slowly and carefully over time. You need to protect that in any way you can.

One way to protect your branding is to protect its key elements: your name and your logo. And one way to do that is to trademark those elements. We have acted for a number of small businesses who have successfully trade-marked their logo or name. We have also taken action against persons who use names or logos which are confusingly similar to those of our clients.

Copyright can exist in a wide range of material. We can help you identify your rights, or assist you in defending against claims of copyright infringement. In the past, we have worked with a wide array of Hollywood studios, such as Warner, Paramount and Disney, and with major sports organizations, including the NHL and NASCAR, in negotiating copyright licences and usage agreements.

We can also assist you in the protection of trade secrets and confidential information.

Due to the very technical nature of patent applications, we do not pursue patent applications on behalf of clients. We can provide you with referrals to patent lawyers who may meet your needs.
